1. General provisions

1.1 «The policy of Yousee LTD (hereinafter also referred to as the Company) regarding the processing of personal and non-personal data» (hereinafter referred to as the Policy) defines the position and intentions of the Company in the field of processing and protection of personal and non-personal data, in order to respect and protect the rights and freedoms of each person and, in particular, the right to privacy, personal and family secrets, protection of their honor and good name.

1.2. The Policy is strictly implemented by the managers and employees of Yousee LTD.

1.3. The Policy applies to all personal and non-personal data of subjects processed by the Company with or without the use of automation tools.

1.4. Any personal and non-personal data subject has access to this Policy.

1.5. Personal data - any information related to a specific or identifiable individual (citizen). I.e., such information, in particular, can include full name, year, month, date of birth, address, and other information.

1.6. Non-personal data - any information related to the implementation of the Company services submitted by the client, which does not, of itself, directly identify the individual. 1.7. Personal data processing - any action (operation) or a set of actions (operations) with personal data performed using automation tools or without using such tools. Such actions (operations) include collection, receipt, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

1.8. Non-personal data processing - any action (operation) or a set of actions (operations) with non-personal data performed using automation tools or without using such tools. Such actions (operations) include collection, receipt, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), analysis, blocking, deletion, destruction of non-personal data.

1.9 Personal and non-personal data operator (hereinafter also referred to as the Operator) Yousee LTD, International House, 142 Cromwell Road, London, Great Britain, SW7 4EF, phone: +44 84 49864868, email: hello@yousee.studio, website https://yousee.studio that independently or jointly with other persons organizes and (or) performs the processing of personal and non-personal data, as well as determines the purposes of processing personal and non-personal data, the composition of personal and non-personal data to be processed, actions (operations) performed with personal and non-personal data.

1.10. Personal data subject – an individual to whom personal data is directly related (hereinafter referred to as the "User"). Transfer (in any form) the User's personal data to the Operator means the User's consent to the Operator's processing of their personal data in accordance with this Policy.

1.11. Non-personal data subject – an individual or a legal entity (hereinafter referred to as the "User") by whom non-personal data is submitted. Transfer (in any form) the User's non-personal data to the Operator means the User's consent to the Operator's processing of their non-personal data in accordance with this Policy.

1.12. Confidentiality of personal data – the principle of personal data processing, according to which operators and other persons who have access to personal data are obliged not to disclose or distribute personal data to third parties without the consent of the personal data subject unless otherwise provided by Federal law. Under the privacy of personal data, Yousee LTD understands the protection of personal data from unauthorized or accidental access to it, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other illegal actions in relation to personal data and takes the necessary legal, organizational and technical measures to protect personal data.

Confidentiality of non-personal data – the principle of non-personal data processing, according to which operators and other persons who have access to non-personal data are obliged not to disclose or distribute non-personal data to third parties without the consent of the non-personal data subject unless otherwise provided by Federal law. Under the privacy of non-personal data, Yousee LTD understands the protection of non-personal data from unauthorized or accidental access to it, destruction, modification, blocking, copying, provision, distribution of non-personal data, as well as from other illegal actions in relation to non-personal data and takes the necessary legal, organizational and technical measures to protect non-personal data.

2. Rights of the personal data subject

2.1. A citizen whose personal data is processed by Yousee LTD has the right to receive from Yousee LTD:

  • name and location of the Company;

  • the list of processed personal data related to the citizen from whom the request was received and the source of their receipt, unless a different procedure for providing such data is provided by Federal law;
  • information about the terms of processing of personal data, including the terms of their storage;
  • name and address of the person who processes personal data on behalf of Yousee LTD;
  • other information provided by the Federal laws;

2.2. Request clarification of their personal data, their blocking or destruction if the personal data is incomplete, outdated, inaccurate, illegally obtained, or is not necessary for the stated purpose of the processing;

2.3. Revoke their consent to the processing of personal data;

2.4. Demand the elimination of unlawful actions of Yousee LTD in relation to its personal data;

2.5. Appeal against the Company's actions or omissions in court if a citizen believes that the Company processes their personal data in violation of the requirements of Federal laws or otherwise violates their rights and freedoms;

2.6. To protect their rights and legitimate interests, including compensation for damages and/or compensation for non-pecuniary damage in court.

3. Rights of the non-personal data subject

3.1. A citizen or legal entity whose non-personal data is processed by Yousee LTD has the right to receive from Yousee LTD:

  • confirmation of the fact of non-personal data processing legal grounds and purposes of non-personal data processing;
  • information about the methods of non-personal data processing used by the Company;

  • creating an account for the possibility of entering into a purchase and sale agreement with the Company and subsequent identification of the personal data subject registered on the Site when concluding and executing contracts.

8. Procedure, principles, and conditions of personal data and non-personal processing

8.4. Yousee LTD has the right to entrust the processing of personal data and non-personal data of citizens to third parties on the basis of a contract concluded with these persons.

8.5. Persons who process personal data and non-personal data on behalf of Yousee LTD must comply with the local principles and rules for processing and protecting these data. For each person, a list of actions (operations) with personal data and non-personal data that will be performed by a legal entity that processes these data, the purpose of processing, the obligation of such a person to maintain confidentiality and ensure the security of these data during their processing, and the requirements for the protection of these data being processed are specified.

8.6. In cases established by the legislation, Yousee LTD has the right to transfer personal data and non-personal data of Users.

  • information confirming participation in the relationship with Yousee LTD or information that otherwise confirms the processing of personal and/or non-personal data by Yousee LTD;
  • signature of the User (or their legal representative). If the request is sent in electronic form, it must be issued as an electronic document and signed with an electronic signature.

10. Personal data protection measures

10.1. When processing personal data, Yousee LTD takes the necessary legal, organizational, and technical measures to protect personal and non-personal data from unauthorized or accidental access to it, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other illegal actions with regard to personal and non-personal data.

Such measures include:

  • identification of threats to the security of personal and/or non-personal data when processing them in data information systems;
  • application of organizational and technical measures to ensure the security of personal and/or non-personal data during their processing in data information systems, necessary to meet the requirements for personal and/or non-personal data protection;
  • use of information security tools that have passed the compliance assessment procedure in accordance with the established procedure;
  • evaluating the effectiveness of measures taken to ensure the security of personal and/or non-personal data prior to commissioning of the data information system;
  • detection of unauthorized access to personal and/or non-personal data and taking measures;
  • recovery of personal and/or non-personal data modified or destroyed due to unauthorized access to it;
  • establishing rules for access to personal and/or non-personal data processed in the data information system, as well as ensuring registration and accounting of all actions performed with personal and/or non-personal data in the data information system;

Yousee Ltd hereinafter referred to as the "Company" by this publication of the offer Agreement, expresses its intention to conclude a contract for the provision of 3D visualization services with any interested individuals or legal entities (hereinafter referred to as the "Client") on the terms set out in this offer Agreement, estimate and the invoice for services.

The moment of full and unconditional acceptance of the Company's offer to conclude a contract (i.e., acceptance of the offer) is considered to be the payment for services on the Company's account.

By paying for the Company's services, the Client confirms that they have read and agreed to all the terms of this offer Agreement, including the appendices to the Agreement, which are an integral part of it.

1. TERMS AND DEFINITIONS

1.1. "3D visualization" - a photorealistic image of the Client's project according to a previously prepared Visualization Task, created using specialized computer programs.

1.2. "Visualization Task" - a source document for the development of 3D visualizations in the form of a brief describing all the Client's requirements for 3D visualization.

1.3. "Source material" - visual materials necessary for visualization, including two-dimensional projections of the project (scans and layouts), a list and description of the materials used, sketches, and examples of images directly or indirectly employed in creating 3D visualizations.

1.4. "Adjustments" - making changes or additions to the result of 3D visualization that are not related to the Company's errors. The type of adjustments is limited at each stage:

  • The first set of adjustments is allowed after the first preliminary 3D visualization. It refers to the viewpoint, camera angle, the number of details and pieces of furniture (according to the selected price option)
  • The second set of adjustments is made after the second draft is received. It is still possible to remove and add elements, choosing them from the library on the Basic and Standard price option level or sending to the Company the reference image for tailor-made modeling on the Advanced price option level
  • The third set of adjustments is made after receiving the first color image (third workflow draft) with a demonstration of the materials used. At this stage, the Client can make adjustments for colors (according to the RAL palette) and materials (by sending the reference images).
  • The fourth set of adjustments is available to the Clients who have ordered Standard and Advanced price options levels and applies to the amendment of the used decor details.
  • The fifth, final, set of adjustments is available to the Clients who have ordered Advanced price option level and is applicable to the used visual effects
  • Adjustments can be made after receiving the final image at any time for an additional fee and after paying the Сompany's additional invoice.

1.5. "Website" - the Company website with a domain name www.yousee.studio where the current version of this offer Agreement is published together with information about the Company's prices, contacts, and other information about the Company and its services.

2. SUBJECT OF THE AGREEMENT

2.1. The Company undertakes to create a 3D visualization on the Client's Visualization Task, and the Client undertakes to accept the services provided and pay for them.

2.2. The Client's Visualization Task is an integral part of this Agreement. It contains the source material and reflects all the Client's wishes for the design and results of 3D visualization.

2.3. Based on the Visualization Task, the Company prepares and sends an estimate and invoice to the Client. The estimate reflects the cost of services, stages, and timing of visualization. Payment of the invoice means acceptance of the terms of this Offer Agreement and the estimate.

3. COST OF SERVICES AND PAYMENT PROCEDURE

3.1. The cost of the Company's services is indicated in Euros. It is determined based on the Company's current price rates, taking into account the volume of services provided and other Client' wishes.

3.2. The Company's services are subject to VAT in accordance with UK law.
